Trademark, Independence, Product, Vehicle Brokerage & Bespoke Development Disclaimer
1. Trademark & Independence Notice
Land Rover Swamp is an independent specialist, seller, curator, designer and intermediary for used, vintage, collectible and previously circulated goods, accessories, spare parts, trade items, classic vehicles and bespoke vehicle concepts relating to classic Land Rover, Range Rover, Defender, Series Land Rover, Jaguar vehicles, Camel Trophy memorabilia and automotive heritage products.
Land Rover Swamp is not affiliated with, authorised by, endorsed by, sponsored by, licensed by or acting on behalf of Worldwide Brands, Inc., Jaguar Land Rover Limited, Jaguar Land Rover Automotive PLC or any of their affiliated companies, subsidiaries, representatives or rights holders.
“Camel Trophy”, “Camel”, “Land Rover”, “Range Rover”, “Defender”, “Discovery”, “Jaguar” and all related names, logos, emblems, badges, model names, product names and trademarks are registered trademarks, trademarks or protected identifiers of their respective owners.
Any use of these names or marks is made solely for descriptive purposes, historical reference, product identification, compatibility information or to accurately describe the goods, vehicles, spare parts, accessories, concepts or services offered.
Land Rover Swamp does not manufacture official Camel Trophy, Jaguar or Land Rover branded products and does not sell goods, vehicles or services on behalf of the respective rights holders, unless expressly stated otherwise in writing.
Product images, vehicle images, logos, emblems or trademarks shown on offered items, vehicles or concepts are part of the actual condition, appearance, historical character or descriptive identification of the respective goods, vehicles or projects.
2. Used Goods, Collectibles, Spare Parts & Trade Items
Unless expressly stated otherwise, all Camel Trophy items offered in our shop are used original items, vintage goods, collector’s items or trade goods that have already been lawfully placed on the market.
The same applies to Jaguar, Land Rover, Range Rover, Defender and other marque-related products, spare parts, accessories and memorabilia offered by Land Rover Swamp.
All items are sold in the condition described in the respective product listing. Due to the nature of used, vintage and historical goods, signs of age, storage, wear, patina, previous use, restoration, repair or modification may be present and do not constitute a defect where they are described, visible in the product images or typical for goods of this age and type.
For spare parts, accessories and technical components, the buyer is responsible for checking compatibility before purchase. This includes, in particular, vehicle model, production year, specification, part number, dimensions, connections, mounting points, condition and intended use.
A binding compatibility confirmation only exists where expressly confirmed by Land Rover Swamp in writing.
Where an item has been ordered based on an incorrect part number, incorrect vehicle allocation, incorrect assumption or unsuitable intended use by the buyer, this does not constitute a defect if the delivered item corresponds to the product description.
3. Classic Vehicle Brokerage, Sourcing & Sales Disclaimer
Land Rover Swamp is an independent specialist for the sourcing, presentation, marketing and brokerage of classic vehicles, with a particular focus on classic Land Rover, Range Rover, Defender, Series Land Rover and Jaguar vehicles.
Unless expressly stated otherwise in writing, Land Rover Swamp acts as an independent intermediary, broker, curator, sourcing partner, marketing partner or introducer between the vehicle owner, seller and prospective buyer.
Land Rover Swamp does not automatically act as the legal seller, owner, importer, manufacturer, restorer, workshop, dealer of record or contractual counterparty for the sale of a vehicle, unless this is expressly agreed in the respective purchase agreement, invoice or written transaction documents.
All vehicle descriptions, specifications, histories, images, videos, mileage statements, restoration details, ownership information, matching-numbers references, originality statements, valuation comments and condition reports are prepared with care and based on the information available at the time of publication.
Such information may be provided by sellers, owners, workshops, previous custodians, archives, registration documents, third-party experts or visual inspection. Unless expressly confirmed in writing, Land Rover Swamp does not independently guarantee the completeness, accuracy or legal effect of such information.
Classic vehicles are historic, used and mechanically aged goods. Even where a vehicle has been restored, maintained, recommissioned or presented in excellent condition, age-related wear, previous repairs, corrosion, mechanical tolerances, electrical faults, oil leaks, water ingress, patina, non-original parts, historic modifications, incomplete documentation or future maintenance requirements may be present.
These characteristics are typical for classic vehicles and do not automatically constitute a defect.
Any prospective buyer is responsible for conducting their own due diligence before purchase. This includes, where appropriate, arranging an independent inspection, road test, workshop assessment, valuation report, document check, title check, registration check, import/export check and verification of the vehicle’s suitability for the buyer’s intended country of use.
Land Rover Swamp does not guarantee that a vehicle will comply with the roadworthiness, registration, taxation, import, export, emissions, safety, insurance or technical requirements of any specific country, state or jurisdiction.
The buyer is responsible for checking all local requirements before entering into a purchase agreement.
Unless expressly agreed otherwise, vehicles remain subject to prior sale, price change, withdrawal from sale or changes in availability. A vehicle is only reserved or secured when this has been expressly confirmed in writing and, where applicable, the agreed deposit or reservation payment has been received.
Any purchase agreement is concluded between the parties named in the respective transaction documents.
Where Land Rover Swamp acts only as broker, introducer or intermediary, any statutory warranty, contractual warranty, guarantee, title obligation, delivery obligation or post-sale obligation relating to the vehicle lies with the respective seller, unless Land Rover Swamp has expressly assumed such obligation in writing.
No statement by Land Rover Swamp shall be interpreted as a manufacturer warranty, commercial guarantee, roadworthiness guarantee, investment advice, financial advice or binding promise of future value development.
Any valuation, market assessment or price indication reflects an opinion based on the classic vehicle market at the relevant time and may change.
Test drives, inspections, transport, loading, storage, export, import, customs clearance, registration and any work carried out after purchase are undertaken at the buyer’s own risk and cost, unless expressly agreed otherwise in writing.
4. Bespoke Design, Vehicle Development & Commissioned Collector Vehicles
Land Rover Swamp develops bespoke design concepts, visual studies, vehicle specifications, colour concepts, interior concepts, exterior treatments, digital renderings, design presentations and complete vehicle development ideas for classic Land Rover, Range Rover, Defender, Series Land Rover and Jaguar vehicles.
Such concepts and developments are created independently by Land Rover Swamp and are not official factory designs, manufacturer programmes, continuation vehicles, special editions or licensed products of Jaguar Land Rover, Land Rover, Range Rover, Defender, Jaguar or any related rights holder, unless expressly stated otherwise in writing.
Where a design or vehicle concept is further developed into a physical vehicle, Land Rover Swamp may work with selected independent workshops, craftsmen, restoration specialists, technical partners, suppliers and build partners.
These projects are carried out on a bespoke commission basis and are subject to technical feasibility, donor vehicle availability, budget, timeline, parts availability, legal requirements and the terms of the individual commission agreement.
Unless expressly agreed otherwise in writing, Land Rover Swamp acts as the design, concept, creative direction, sourcing and project coordination partner.
The actual mechanical, structural, electrical, bodywork, paint, upholstery, restoration, conversion, engineering or roadworthiness-related work may be carried out by independent third-party partners, workshops or specialists.
Such partners remain responsible for their respective scope of work, workmanship, technical execution, workshop warranties and statutory obligations, unless otherwise agreed in the applicable contract.
All commissioned vehicles are based on used, historic or previously registered vehicles. Even after restoration, recommissioning, refurbishment, conversion, redesign or bespoke development, such vehicles remain classic used vehicles and may retain age-related characteristics, mechanical tolerances, previous repairs, non-original components, historical modifications, patina or future maintenance requirements.
Digital renderings, design visuals, concept images, moodboards, specifications, colour references and project presentations are intended to communicate the creative direction of a project.
They do not constitute a binding representation of the final physical vehicle unless expressly incorporated into the final written specification or commission agreement.
Final results may vary due to technical feasibility, material behaviour, workshop execution, donor vehicle condition, regulatory requirements, parts availability or agreed project changes.
The client is responsible for verifying whether a commissioned vehicle, modification, conversion, restoration, colour change, interior specification, technical upgrade or design development is suitable and legally permissible for the intended country of registration, road use, insurance, import, export, taxation and ownership.
Land Rover Swamp does not guarantee registration, road approval, MOT, TÜV, emissions compliance, insurance acceptance or roadworthiness in any specific jurisdiction unless expressly confirmed in writing as part of a separate contractual obligation.
No statement, rendering, specification, proposal, design study or project presentation by Land Rover Swamp shall be interpreted as a manufacturer warranty, factory approval, homologation confirmation, legal registration advice, investment advice or guarantee of future market value.
All designs, renderings, concepts, specifications, layouts, visual studies, naming ideas, project presentations, image compositions and creative developments created by Land Rover Swamp remain the intellectual property of Land Rover Swamp, unless expressly assigned or licensed in writing.
No concept, design, rendering, specification or project material may be copied, reproduced, modified, built, commissioned with third parties, published, sold or commercially used without prior written consent from Land Rover Swamp.
5. Warranty, Buyer Responsibility & Limitation of Liability
Statutory warranty rights apply in accordance with German law.
For used goods sold to consumers, the statutory warranty period may be reduced to one year where legally permitted and effectively agreed.
For business customers, the warranty provisions set out in our Terms and Conditions apply.
Damage, malfunction, loss of value or incompatibility caused after delivery by improper handling, incorrect installation, incorrect use, unsuitable tools, incorrect vehicle allocation, lack of maintenance, unauthorised modification, improper storage, unsuitable operating fluids, excessive stress or any other circumstance attributable to the buyer does not constitute a defect in the delivered item.
To the fullest extent permitted by law, Land Rover Swamp shall not be liable for indirect losses, consequential damages, loss of profit, loss of use, failed registration, failed import, workshop costs, transport costs, customs costs, tax consequences or buyer-side errors arising from incorrect assumptions, unsuitable intended use, incomplete due diligence, incorrect handling, improper storage, unauthorised modifications or third-party work carried out after purchase.
Nothing in this disclaimer limits or excludes liability where such limitation or exclusion is not permitted by law, including liability for intent, gross negligence, injury to life, body or health, fraudulently concealed defects or mandatory statutory consumer rights.
6. Returns, Withdrawal & Return Shipping
Consumers may have a statutory right of withdrawal for distance selling contracts, unless a legal exception applies. The statutory right of withdrawal remains unaffected.
The direct cost of return shipping shall be borne by the buyer, provided that the buyer has been properly informed of this before conclusion of the contract and where legally permitted.
The buyer may be liable for any loss in value of the goods where such loss results from handling that was not necessary to inspect the nature, characteristics and functioning of the goods.
This may include, in particular, installation, attempted installation, use, damage, soiling, modification, removal of tags or labels, missing packaging for collector’s items or any handling beyond reasonable inspection.
In the case of justified statutory warranty claims, the buyer’s statutory rights remain unaffected.
7. International Orders, Import, Export & Governing Law
Land Rover Swamp is based in Germany and sells internationally.
For deliveries outside Germany, customs duties, import taxes, fees or other charges may apply. These costs are borne by the buyer unless expressly stated otherwise during the checkout process.
The buyer is responsible for complying with all applicable import, export, customs, registration, road-use, insurance, taxation and product regulations in the destination country.
German law applies to all contractual relationships.
For consumers, this choice of law applies only to the extent that it does not deprive the consumer of mandatory consumer protection rights applicable in the country of their habitual residence.
